1. Acceptance of Terms

By accessing or using the Dicoin platform ("Platform", "Service", "we", "us"), creating an account, or generating a wallet through our interface, you ("User", "you") unconditionally agree to be bound by these Terms of Service and Privacy Policy in their entirety.

If you do not agree with any part of these terms, you must immediately cease using the Platform. Continued use of the Platform constitutes your acceptance of any updates or modifications to these Terms.

2. Nature of the Service

Dicoin is an educational and financial technology platform designed to teach users about digital stablecoins (USDT, USDC) and provide tools for managing digital assets. The Platform operates in two distinct modes:

3. Eligibility

You must be at least 18 years of age to use this Platform. By registering, you represent and warrant that you are 18 or older and have the legal capacity to enter into a binding agreement. Use of the Platform is void where prohibited by applicable law.

4. Wallets, Private Keys & Your Responsibility

When you register, Dicoin generates a real Ethereum-compatible wallet address and private key on your behalf. The private key is encrypted using AES-256-GCM with your password before being stored.

🔑 NEVER share your private key or password with anyone — including Dicoin staff. We will never ask for it.

5. Platform Fees & Network Gas Fees

By using Dicoin's trading and transfer features, you agree to the following fee structure. All applicable fees are displayed clearly on-screen before you confirm any operation. You must review and accept the fee breakdown before any transaction is executed.

Network Gas Fees are fees charged by the underlying blockchain network (Ethereum, Polygon, Arbitrum, or others as applicable) to process and validate your transaction. These fees are:

Platform Fee (0.5%): Dicoin charges a 0.5% fee on each buy or sell operation. This fee is collected to maintain and operate the platform. It is always shown in the transaction preview screen before confirmation.

⚠️ You are solely responsible for all gas fees associated with your transactions. Dicoin will not reimburse gas fees for failed, reversed, or mistaken transactions. Always review the full fee breakdown shown before confirming any operation.

6. Third-Party Fiat-to-Crypto Services (MoonPay)

Dicoin integrates with MoonPay (MoonPay International Limited and its affiliates) to provide fiat-to-cryptocurrency purchase and sale services directly within the Platform. When you use the "Buy with MoonPay" feature, you are accessing a service operated by MoonPay, not by Dicoin.

By using MoonPay through our Platform, you expressly acknowledge and agree that:

ℹ️ Dicoin may receive a referral commission from MoonPay for users who complete purchases through our integration. This does not affect the price you pay — MoonPay's rates are the same regardless of the referral source.

Dicoin may integrate additional third-party payment or exchange providers in the future. Each such integration will be disclosed, and the same principles of third-party responsibility described in this section will apply.

7. Limitation of Liability & Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DICOIN AND ITS CREATOR, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, SUPPLIERS, AND AFFILIATES (COLLECTIVELY, "DICOIN PARTIES") SHALL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES WHATSOEVER ARISING FROM OR RELATED TO YOUR USE OF, OR INABILITY TO USE, THE PLATFORM.

This limitation applies regardless of the legal theory asserted and even if Dicoin has been advised of the possibility of such damages. Without limiting the foregoing, Dicoin Parties expressly disclaim all liability for:

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, OR THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.

In no event shall the total aggregate liability of Dicoin Parties for all claims related to the Platform exceed the greater of (i) the total platform fees paid by you to Dicoin in the six (6) months preceding the claim, or (ii) MXN $500.00 (five hundred Mexican pesos).

While Dicoin implements industry-standard security measures including AES-256-GCM encryption and PBKDF2 key derivation, no system is completely immune to attack. You acknowledge and agree that:

We do not sell, rent, or share your personal data with third parties for marketing purposes. Data may be disclosed to competent authorities when required by applicable Mexican law, court order, or to prevent fraud and money laundering.

By using the Platform, you consent to the collection and use of information as described in this section and as required by applicable privacy law (Ley Federal de Protección de Datos Personales en Posesión de los Particulares, Mexico).

10. Know Your Customer (KYC) & Anti-Money Laundering (AML)

Dicoin is committed to preventing money laundering, terrorist financing, and other financial crimes. In compliance with applicable Mexican law — including the Ley Federal para la Prevención e Identificación de Operaciones con Recursos de Procedencia Ilícita (LFPIORPI) and related regulations — and international standards (FATF recommendations), Dicoin reserves the right to apply the following measures at any time:

⚖️ Using Dicoin for money laundering, terrorist financing, sanctions evasion, or any other financial crime is strictly prohibited and will result in immediate account termination and mandatory reporting to Mexican and international authorities. Dicoin cooperates fully with all lawful requests from competent authorities.

12. Refunds, Web Errors & Cross-Chain Transfer Risks

General Refund Policy:

Due to the irreversible nature of blockchain transactions, Dicoin does not offer refunds for completed cryptocurrency transactions. Once a transaction has been broadcast to the blockchain network and confirmed, it cannot be reversed, cancelled, or retrieved by Dicoin or any other party.

Platform / Web Errors:

In the event of a demonstrable technical error originating solely from Dicoin's platform (not from the blockchain network, user error, or third-party service), Dicoin will investigate the incident on a case-by-case basis. Dicoin makes no guarantee of compensation and any goodwill resolution is at Dicoin's sole discretion. To report a platform error, contact us immediately with transaction details, timestamps, and screenshots.

⚠️ CRITICAL WARNING — Cross-Chain Transfers:

CROSS-CHAIN TRANSFERS ARE NOT SUPPORTED BY DICOIN.

A cross-chain transfer occurs when you send a token from one blockchain network to a wallet address on a different, incompatible blockchain network. For example: sending USDC on the Ethereum network to a wallet address that only operates on Polygon, Arbitrum, BNB Chain, Solana, or any other network — or vice versa.

Cross-chain transfers sent to unsupported networks WILL RESULT IN PERMANENT, TOTAL, AND IRRECOVERABLE LOSS OF YOUR TOKENS.

Dicoin CANNOT and WILL NOT attempt to recover tokens sent to an incompatible network address. No refund, compensation, or reimbursement will be provided under any circumstances.

Before sending any digital asset, you MUST verify:
① The exact blockchain network the recipient address operates on.
② That the recipient address supports the specific token and network you are sending.
③ That you are not using a bridge, wrapped token, or multi-chain address without fully understanding the implications.

IF YOU ARE UNSURE, DO NOT SEND. Once sent, the loss is permanent.

Dicoin expressly disclaims all liability for any token loss resulting from cross-chain transfer errors, regardless of the cause, including but not limited to: user confusion between networks, interface display errors, copy-paste mistakes, or third-party wallet incompatibilities.

13. Termination

Dicoin reserves the right to suspend or terminate your account and access to the Platform at any time, with or without notice, for any violation of these Terms or for any other reason at Dicoin's sole discretion. Upon termination, your right to use the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination shall survive, including sections on Limitation of Liability, Indemnification, KYC/AML, and Governing Law.

14. Indemnification

You agree to indemnify, defend, and hold harmless Dicoin and the Dicoin Parties from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (i) your access to or use of the Platform; (ii) your violation of these Terms; (iii) your violation of any applicable law or third-party right; (iv) any transaction you initiate through or in connection with the Platform; or (v) any cross-chain transfer error or misuse of MoonPay services.

15. Governing Law & Dispute Resolution

These Terms of Service and all matters arising from or related to the use of the Dicoin Platform shall be governed by, construed, and enforced exclusively in accordance with the laws of the United Mexican States (México), including but not limited to:

Jurisdiction: The parties expressly submit to the exclusive jurisdiction of the competent courts of Mexico City (Ciudad de México), México for the resolution of any dispute arising from or relating to these Terms or your use of the Platform. You irrevocably waive any objection to such jurisdiction or venue.

Dispute Resolution: Before initiating any legal proceeding, the parties agree to attempt good-faith negotiation for a period of thirty (30) calendar days from written notice of the dispute. If unresolved, disputes shall be submitted to binding arbitration administered in accordance with the rules of the Centro de Arbitraje de México (CAM), conducted in Spanish in Mexico City.

If you are accessing the Platform from outside Mexico, you are responsible for compliance with your local laws in addition to Mexican law.

16. Changes to Terms

Dicoin reserves the right to modify these Terms at any time. Changes will be effective upon posting to the Platform. Material changes will be communicated to registered users via email or prominent Platform notice. Your continued use of the Platform after any changes constitutes your acceptance of the revised Terms.

By using Dicoin you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and Privacy Policy in their entirety, and that Mexican law governs your use of this Platform.
